Fatwa On Participation With Non-Muslims In Agreements And Meetings (London Conference 2002)

At the end of 2002, preparations began in London to hold a conference for the Iraqi opposition abroad, in which Iraqis of all sects, Muslims and non-Muslims, would participate to discuss the situation in Iraq at that time. and meetings.

After its convening and explaining its truth, connections and goals, Sheikh Abdul Karim Zaidan issued a statement about this conference and the decisions it issued.

Question : What is the legal ruling on participating with a non-Muslim in agreements and meetings?

Answer : Praise be to Allah, Lord of the Worlds, and prayers and peace be upon the Master of the Messengers, Muhammad, and upon all his family and companions, and after:

First:  It is permissible to participate - the participation of a Muslim with others - even if he is not a Muslim, provided that the subject matter of the partnership or the agreement is legally permissible, and the evidence for this is from the  following:

The First Aspec: The treaty of the Prophet, peace and blessings be upon  him,  with the Jews of Yathrib (Madina). It was stated in this treaty:

(And that among them victory over those who fought the people of this newspaper)

The Second Aspect: The Treaty of Hudaybiyah, where the Prophet, peace and blessings be upon  him,  concluded the treaty of Hudaybiyah, and from it, (the war between the two parties was set for ten years in which people would be safe and some would refrain from others) (And whoever likes to enter into the contract and covenant of the Prophet,  ﷺ,  enters into it, and whoever likes to enter into the contract and covenant of Quraysh He entered into it, and he who enters into the contract of a party of the two parties is considered a part of it, and the aggression against him is considered an aggression against the party he joined) The  Khuza’ah tribe joined the contract and covenant of Muhammad, peace be upon  him, and the Banu Bakr joined the Quraysh.

The Third Aspect: The curiosity alliance that took place between the stomachs of the Quraish and its content their alliance to support the oppressed against the oppressor, regardless of his tribe or the belly of the oppressor and the oppressed. Bin Jadaan, they allied themselves to be with the oppressed, as long as he pulled his wool, and if I were called to someone like him in Islam, I would have answered.

Second:  Based on the foregoing, it is permissible for you to participate with the two congregants, even if their tendencies and beliefs differ, provided that the goal is the following:

  - Pposition and  resistance by any legitimate means to the American attack on Iraq, whatever the motives and whatever the purposes of their attack.

  - Demanding the government (to release the legitimate freedoms of the people) and for the final statement to include these words because they are intended and should not be neglected.

Third:  You do not need to be a member of the committee supervising this gathering.

Fourth:  That you and those Muslims who are with you remain your Islamic character in what you say and suggest, and your argument for the gathering will be: That it is agreed upon among us that we hold the creed of Islam, so our actions and means should not be contrary to Islam, and in Islam it is sufficient to achieve our goals in fighting and resisting the aggression of the Americans, and in Our demands for the government to release the legitimate freedoms of the people.

And may Allah’s prayers and peace be upon our master Muhammad and his family and companions all, and praise be to Allah, Lord of the worlds.

Statement By Sheikh Abdul Karim Zidan After The London Conference Of The Iraqi Opposition

Peace be upon you and Allah's mercy and blessings be upon you:

We have previously issued a fatwa prohibiting cooperation with the aggressors American infidels, so they prepare to attack our Muslim country, Iraq. This fatwa went to prohibiting the mere heartfelt inclination for the Americans to enter and occupy Iraq. This fatwa was unanimously agreed by scholars on its content, and it became a legal duty to act upon it, because opposing it is considered a violation of the consensus reached on it, even if it was a silent consensus.

We were horrified and afflicted that a group of those claiming to represent Ahl al-Sunnah wal-Jama`ah should participate in the follow-up committee emanating from the opposition conference that was held under the tent of the Americans and according to its planning. This group, with its disgraceful act, represents only itself and is not fit to represent other people of the Sunnah and the Community, because by participating in the Follow-up Committee of the American Opposition Conference, it lost its justice and revealed its ignorance of the simplest meanings of Islam, which is the prohibition of helping an infidel who declares that he wants to attack Iraq, the Muslim country. It is well known that the one who lacks justice or is ignorant of the rulings of Islam is not fit to be a leader, representative, representative, or guide for others. Based on the foregoing, every Muslim who has an association with this group or whoever supports it must denounce it and disassociate itself from it and follow it, because this group, by its disgraceful act, has taken other than the way of the believers in refraining from helping the Americans through their conference called the opposition conference.And who does not do so and declares his innocence from them and supported by him, he presents himself because he said in the verse of Al-Nisaa:

(وَمَن يُشَاقِقِ الرَّسُولَ مِن بَعْدِ مَا تَبَيَّنَ لَهُ الْهُدَىٰ وَيَتَّبِعْ غَيْرَ سَبِيلِ الْمُؤْمِنِينَ نُوَلِّهِ مَا تَوَلَّىٰ وَنُصْلِهِ جَهَنَّمَ ۖ وَسَاءَتْ مَصِيرًا)

(And whoever opposes the Messenger after guidance has become clear to him and follows other than the way of the believers - We will give him what he has taken and drive him into Hell, and evil it is as a destination).

And may Allah’s prayers and peace be upon our master Muhammad and his family and companions, and praise be to Allah, Lord of the worlds.
