A Statement On The Legal Position Regarding The Aggression That Is Taking Place In Iraq (Invasion Of Iraq 2003 AD)

On Wednesday, Muharram 16, 1424 AH, corresponding to March 19 2003 AD, the operation of the invasion of Iraq began, which led to the military occupation of Iraq by the United States of America and the assistance of other countries such as Britain, Australia and some countries allied with America, and in this period Sheikh Abdul Karim Zidan issued a statement about This great catastrophe, indicating the legal adaptation of it, and what Muslims, individuals, peoples and states must do, and the following is the text of the statement, which is a legal fatwa on this subject:

Praise be to Allah, guardian of the believers. There is no aggression except against the oppressors and the unbelievers. And blessings and peace be upon the Messenger Muhammad and all his brothers among the prophets, his family and companions, and those who are guided by his guidance until the Day of Judgment.

We refer to our statement signed by Iraqi scholars abroad on Shaban 29, 1423 AH - coincident 4/11/2002 AD, which includes the Sharia ruling for the expected threats of aggression against Iraq at that time.

And now that the catastrophe and the great catastrophe has occurred and the infidel enemy attacked the Muslim country, Iraq, where he attacked it from the air, land and sea, which Hulagu did not do in his attack on Iraq in the seventh century AH, and it has become a well-known repeated speech that is not hidden even for the elderly, boys and children, that jihad is It became an personal obligation, for the land was occupied, indecent assault, sacred acts violated, lives lost, and property destroyed. And all of this in an audible and visible way, which provokes the haleem and restores the feverishness of the lost. Now we want to clarify what comes, reminding and warning:

First - The Final Reminder Of The Legal Duty Of Every Muslim Ruler

The legal duty of every Muslim ruler in any Arab Muslim country, and in any other Muslim country, to announce the general mobilization - that is, the general mobilization - of the army and the general population, because this is the legal duty of the ruling Muslim if the infidel occupies an Islamic country . The general horn is intended to prepare everyone himself for combat.

That the Muslim ruler in every Islamic country, especially in the countries bordering Iraq, Egypt and the Gulf states, issue an ultimatum to the American, British and cooperating forces to withdraw immediately from Iraq and announce the start of this withdrawal within a few hours, otherwise other decisive measures will be taken, including:

• Stop pumping oil by Arab and Islamic countries. The oil exporter to disrupt the aggressive war machine from shedding the blood of the Muslim people in Iraq.
  
• Cut diplomatic relations, immediately withdraw ambassadors from the capitals of the countries of aggression, and expel their ambassadors from our country. This is the least that is required of the rights of a Muslim over a Muslim. At a time when America is asking the countries of the world to expel Iraqi diplomats, is it not necessary to meet their ploy in the same way?!
  
• Close the skies, lands, waters and corridors of Islamic countries to the machine of barbaric and brutal aggression.
  
• This is followed directly by the issuance of orders by every Muslim ruler for his army and volunteers to go to Iraq immediately to help their brothers and fight the enemy in response to the command of Allah Almighty: 

(And if they seek help of you for the religion, then you must help).

Let every Muslim ruler know that all members of the army are looking for an order from their ruler to go to the victory of Iraq and its people, because the issuance of these heroic soldiers is boiling like a cauldron of anger and rancor seeking revenge against those infidels who humiliated Muslims in every Muslim country, and that rulers know that if they do not do so, this anger will explode The phenomenal may shake them thrones. Let the rulers know that their people will support them and protect their rule with their souls if they announce this sacred alarm.

Let all those who prevent the movement and entry of armies and those with whom volunteers from entering Iraq know that they are considered as the enemy in the worth of fighting and jihad to pay.

Second - The Duty Of Islamic Scholars

The legal duty of Islamic scholars in every Islamic country, especially the Arab countries, led by Egypt, Saudi Arabia, Syria, the Gulf countries, Jordan, and then all other Islamic countries, is to advance the armies that the rulers have enlisted to provide them with spiritual supply and remind them of the wages of the martyrs and their status with Allah Almighty.

And if the rulers do not respond to the announcement of the general mobilization, then the scholars of each Muslim country must go to the ruler and ask him to announce the general mobilization as instructed by Islamic law.

The majority of Muslims must obey the scholars when they announce the mobilization, and this obligation of obedience includes all members of the people, including members of the armed forces, because Allah Almighty says to the believers

(يَا أَيُّهَا الَّذِينَ آمَنُوا أَطِيعُوا اللَّهَ وَأَطِيعُوا الرَّسُولَ وَأُولِي الْأَمْرِ مِنكُمْ)

(O you who have believed, obey Allah and obey the Messenger and those in authority among you). It is due to the scholars and the necessity of their obedience, and because the rulers are required of them to obey the law and that they have the right to obey the people as long as they obey the law and they command what he orders. The scholars are the ones who inform the rulers of the orders of Sharia. People's obedience to the rulers is in fact obedience to the law and its orders, including the obligation to rise to fight the infidels if they occupy Muslim lands.

It is the legal duty of the scholars to meet immediately in their jurisprudence councils in Al-Azhar or in Saudi Arabia or in other countries to announce the general mobilization and announce their advance to the masses of the mujahideen and direct them to Iraq.

Third - The Duty Of All Muslims

And all Muslims, and indeed every Muslim does not hinder him from jihad. A legitimate excuse is the necessity to go to Iraq and participate with the Mujahideen members of the army and volunteers in fighting the enemy in compliance with the command of Allah Almighty in supporting their brothers and in order to attain the testimony that every Muslim desires . And it takes place with the grace of Allah, for everyone who falls in this field is a martyr with Allah Almighty because he defends his religion, honor and homeland, and in this sense the noble hadith came.

If the rulers do not announce the general mobilization, and the scholars do not fulfill their legal duty, then the implementation of the duty of jihad by fighting is transferred to all Muslims, so they form groups and organizations that receive volunteer requests and gather them and seek to transport them to Iraq and provide them with money by collecting donations for them from Muslims . And if such groups and organizations do not fulfill this duty, and the Muslim individual who is able to fight the infidels, the aggressor, is able to go to Iraq to fight the infidels, then he must do so as long as he is able to do so and is not prevented by a legitimate excuse.

Every Muslim must participate in the jihad of the infidels enemies by giving money and any other aid (material, informational and technical) to the mujahideen fighting the enemies, and to the people of Iraq who were harmed and harmed by these infidels, the invading aggressors.

Fourth - The Last Harbinger Of All

The Almighty in Sura Al-Tawba:

(يَا أَيُّهَا الَّذِينَ آمَنُوا مَا لَكُمْ إِذَا قِيلَ لَكُمُ انفِرُوا فِي سَبِيلِ اللَّهِ اثَّاقَلْتُمْ إِلَى الْأَرْضِ أَرَضِيتُم بِالْحَيَاةِ الدُّنْيَا مِنَ الْآخِرَةِ فَمَا مَتَاعُ الْحَيَاةِ الدُّنْيَا فِي الْآخِرَةِ إِلَّا قَلِيلٌ * إِلَّا تَنفِرُوا يُعَذِّبْكُمْ عَذَابًا أَلِيمًا وَيَسْتَبْدِلْ قَوْمًا غَيْرَكُمْ وَلَا تَضُرُّوهُ شَيْئًا وَاللَّهُ عَلَىٰ كُلِّ شَيْءٍ قَدِيرٌ  )

(O you who have believed, what is [the matter] with you that, when you are told to go forth in the cause of Allah, you adhere heavily to the earth? Are you satisfied with the life of this world rather than the Hereafter? But what is the enjoyment of worldly life compared to the Hereafter except a [very] little* If you do not go forth, He will punish you with a painful punishment and will replace you with another people, and you will not harm Him at all. And Allah is over all things competent), Imam Ibn al-Arabi al-Maliki says of the torment that befalls those who fail to fight the infidels and fight them, that in this world the enemy has seized them, and in the hereafter the fire of Hell. This is what the verses brought as a warning and a warning to all of the rulers, scholars and all Muslims.

In conclusion, we ask Allah Almighty to bless the rulers of Muslims in general and the rulers of the Arabs in particular the sincerity of belonging to Islam, sincerity of loyalty with Allah, loyalty with the subjects and respect for their beliefs and feelings. We also ask him for his great ability to sponsor the Mujahideen in Iraq with his care and kindness, and increase their unity and cohesion with strength, determination and steadfastness, and ruggedness against the invading infidels, and he enlightens them with what he cherishes and what the word of Allah is above and by which the invading powers of unbelief are defeated.

Oh Allah, the Revealer of the Book, the Creator of the clouds, the Defeater of the parties, Defeat the aggressor parties of America and those who support it. And make their plot against them. You, O Lord, suffice us and the best agent.
