THE INDIVIDUAL AND THE STATE IN ISLAMIC LAW
(Alfard Waldawlat Fi Alshryet Al'iislamia)
A paper written by the Sheikh in the sixties of the last century and printed in a separate booklet, and also published with a group of researches in a book under the name “Jurisprudence Research Group”, the Sheikh says about this research :

This is a study in the state and the individual's position in Islamic law, in which I relied on the texts of the Holy Qur’an and the Sunnah of the Prophet, the old established historical precedents and the jurisprudence of the jurists .
It has made this research in three chapters :
First : In a statement the country 's position in Islamic law on the one hand should be the extent of its establishment, nature and Ohdvha .... etc .
The second : In explaining the legal status of an individual in the state in terms of the rights he enjoys, and in this chapter :
Individual rights in the Islamic state .
Political rights of individuals .
General rights of individuals .
equality .
Individuals' freedom (First: Personal freedom. Second: Freedom of belief and worship. Third: Inviolability of the home Fourth: Freedom of work Fifth: Freedom of ownership Sixth: Freedom of opinion Seventh: The right to knowledge Eighth: The right of the individual to guarantee the state ).
The third : In the rights that the state has over the individual .
I hope that, with this brief research, I have provided a simple and humble service to Islamic law by presenting one of its organizational aspects related to the subject of the state and the individual's position in it .
